What to do WHEN

The applicants who are eligible for UK spouse visa are required to follow the appended process:

  • Complete online application
  • Make the visa fee payment and Immigration Health surcharge payment
  • Visit the UK VFS to submit their original passport and biometric enrolment
  • The applicant’s documents would be scanned at the UK VFS centre and forwarded to the Home Office from there.

If your UK spouse visa application has been refused- you would be eligible to file an appeal if you feel the decision is incorrect. Any UK spouse visa refusal application is assessed in entirety in order to understand whether the application has merits for an appeal.

Applicants are encouraged to submit documents that they believe would strengthen their application. Typically, the documents that are required to be submitted include:

  • Current passport
  • Documents evidencing the English language requirement (e.g. IELTS Test result, Letter from UK NARIC etc.)
  • Indefinite Leave to Remain or British passport (proof of citizenship) of the sponsor
  • TB test certificate
  • Evidence of relationship (e.g. marriage certificate, chat histories, call logs, joint bank account statement etc)
  • Income threshold of at least £18,600 or alternatively provide evidence of savings amounting to £62,500

The visa interview questions that may be asked by an examining officer include:

  • How did you meet?
  • What did you like about each other?
  • What is your spouse’s favourite colour, food, book, movie etc?
  • What was your first date like?
  • How often do you speak on the phone?
  • How much does your spouse earn?

Types of Visas

UK Fiancé visa

If the application for UK Fiancé Visa is approved, the applicant can enter the UK as a fiancé and register the marriage within six months. This will allow the applicant the further leave to remain in the UK based marriage. Applicants are not allowed to work between this time period.

Requirements to meet:
  • An application as a fiancé to join a person present and settled in the UK and get married in the UK after arriving in the UK as a fiancé
  • Appendix FM of the Immigration Rules
  • Income requirement £18,600
  • Proof of English proficiency test
  • Documents confirming the relationship is genuine

Note: You would have to switch to the UK Spouse visa from within the UK before your Fiancée visa expires.

UK Spouse visa

To apply for UK Spouse Visa the applicant must be above 18 years of age, should possess a marriage certificate while both, applicant and the sponsor should have met in person and are in a genuine relationship with no complication pending from their previous marriages. They should also,

  • Not be related to each other in a way that would be impermissible for marriage
  • Be in a valid marriage or civil partnership
  • Meet the suitability requirements
The sponsor must:
  • Be a British citizen or a permanent resident and should meet gross annual income of at least £18,600/savings of £62,500
Applicant must:
  • Meet the English language requirement
  • Have taken a TB test

UK Unmarried partner visa

To apply for UK Unmarried Partner Visa the sponsor should be a permanent resident of the UK or possess British citizenship. His annual income should at least meet the criteria of £18,600 or should have savings of £62,500. Both the partners should be in a genuine relationship or have been living with each other for at least two years. Also,

  • Meets the English language requirement
  • Has taken a TB Test

UK Civil/Same sex partner visa

To apply for UK Same Sex Visa, the applicant can apply for entry clearance. In case of applicant residing outside the UK, then an entry clearance application as a same sex partner can be submitted to the British High Commission in the country of nationality or country of origin of the applicant.

If the applicant is already in the UK (with a visa issued for longer than six months) then they can switch into same sex partner visa in the UK by making FLR (M) application to the Home Office.

UK Marriage visitor visa

UK Marriage Visitor Visa entitles you to get married or register a civil partnership in the UK or to give a notice for the same. Apply for it if you are not planning to stay or settle in the UK after your marriage or civil partnership.

To apply for UK Marriage Visitor Visa the applicant must prove that they’re 18 or over and able to meet the cost of the return or onward journey as he/she is supposed to be leaving the UK at the end of their visit. He/she

You must apply for a marriage visitor visa if:
  • You wish to give a notice of marriage, to marry or enter into a civil partnership in the UK within 6 months of your arrival
  • You and your partner are in a genuine relationship
  • You would be able to support yourself without working or help from public funds, or that you can be supported and housed by relatives or friends

Steps in Spouse Visa Settlement

ENTRY CLEARANCE
(Apply from outside the UK)

  • Apply for entry to the UK as the Spouse/Civil partner/Unmarried partner of a British national or a person settled in the UK
  • Meet the requirements for entry clearance
  • Initial leave granted is for 33 months (Leave to enter)
  • Usual processing time is 12 weeks
  • Option to get a decision in 4 weeks is available

Yes a UK spouse visa holder is eligible for settlement in UK. This is also understood as marriage settlement visa. In this category the sponsor can bring their spouse to the UK. Anyone who is married to a British citizen or person settled in the UK can apply for a UK spouse visa if they meet the spouse visa requirements. The spouse can permanently join their spouse in the UK after applying for an entry clearance application from outside the UK.
Yes, the applicant can apply for a spouse visa extension and can stay for an additional 30 months which can take the applicant’s total time in the UK on this visa up to five years.
Any applicant (husband/wife) who has been granted a UK spouse visa can apply for extension of leave to remain. If they have lived in the UK for 5 years and meet the requirements of indefinite leave to remain(ILR) – they can apply for ILR. After they have been granted an ILR you may be eligible to apply for naturalization as a British citizen.
As of February 2020, the spouse visa fees for applications outside the UK are £ 1,523 and £1,033 for applications made from within the UK. However, UK visa fees are subject to change; you should always check the latest fees on the Home Office website at the time of applying.

The applicant needs to make a UK spouse visa application to the Home Office. The applicant can make this application from overseas or from within the UK [subject to meeting the requirements]

The applicant, sponsor or their representative is required to complete an online application form, an appendix and provide the relevant supporting evidence in support of the application. They are required to pay the UK spouse visa fee and Immigration Health Surcharge as part of the process.

The applicants are required to submit the supporting documents along with their passports and biometrics, at the local VFS centre. If the sponsor chooses to submit any documents in the UK, they may visit a UKVCAS centre and submit the said documents in support of your application.

The government since 2017 has introduced the minimum income threshold for a British or settled person wishing to sponsor their Non-EU Spouse / partner for a UK spouse visa without dependent children, is £18,600.

An additional gross annual income of £3,800 is required for the first child sponsored in addition to the partner and an additional £2,400 for each further child.

Note: If the financial requirement and other requirements are not met, all the applicants will be refused.

Children under 18 years of age can enter the UK as their parent’s dependants. The applicant can make an application for their dependant at the same time when they make their spouse visa application.

Note: That the sponsor must show income of £22,400 if one child is accompanying the applicant. The level of minimum income varies depending on the number of dependant children being sponsored.
